VOLUNTEER FIRE DEPARTMENTS
BY-LAWS
SECTION 01:
PURPOSE & Mission Statement
Two all volunteer fire departments shall be established in the Eastern part of Morgan county on highway 437(PEDDLER GAP V.F.D.)and
on Highway 172 (HWY 172 V.F.D.). The volunteer fire departments will provide fire and emergency protection, Back up; local and state
Law Enforcement, Morgan County Rescue and Ambulance services, for all residents on and off roads 437 and 172 to the county lines of
Lawrence, Elliott, Johnson and Magoffin counties, except Indian creek, (Rt. 1161) to the mid point,
Hwy 172 west to the junction of Route 172, and the Cow Branch Road to the War Creek Road. Protection also includes areas of Route
# 1260, 589, 706, Dock's creek, Moon, Crockett, Paint creek, Upper and Lower Sandlick, Lost Creek and surrounding areas. The
volunteer fire departments shall be non-profit, fully volunteer, and governed by fire personnel and board of
directors.
SECTION 02: LOCATION
The Peddler Gap fire house is located at 7863 hwy. #437,
The Hwy. 172 fire house is located at 13088 hwy. #172.
SECTION 03: DEFINITIONS
FIRE CHIEF--------- Head of the department, in charge of day -to-day Operations. Must be a certified Fire Fighter
ASSISTANT CHIEF---- Second in command, acts as fire chief when chief is Absent. Must be a certified
firefighter.
CAPTAIN------------ Third in command. Does not have to be a certified fire fighter.
LIEUTENANT------Fourth in command. Does not have to be a certified Frefighter
TREASURER------Member with responsibility to the department for keeping accounts in all areas where
money is received, and expenditures made. (A Treasurer shall
be elected for each Department).
SECRETARY---- Member with responsibility to the department for record keeping, personnel forms,
and other forms.
ACTIVE MEMBER------ May or may not be a firefighter. Must have completed twenty (20) hours of
fire training before making fire runs. Has membership in the department and
regularly attending meetings and participating in the operation of the
Volunteer Fire Department. Active members also aides in maintaining
equipment, fire house, & vehicles.
FIRE PERSONNEL--- Any firefighter, board of director, or active member.
BOARD OF DIRECTORS- Members of the department who may or may not be A firefighter, but is charged
with decisions directly related to the operation, funding and fiscal management
responsibility of the Volunteer fire department(s).
DONATIONS---------- Money received from the Public, individuals, and/or Businesses, for operational
costs of the VFD.
STATE AID---------- Money received annually, if qualification is met, from the Kentucky Fire Commission
for the purchase and maintenance of equipment. (This money cannot be used
for insurance, fuel, or utilities).
SECTION 0 4: STRUCTURE AND BUSINESS:
01- Membership shall be all volunteer.
02-The fire department shall be incorporated.
03-The fire department shall be managed by a local board of
directors.
04-The board of directors has responsibility of managing both the
Peddler Gap & the Hwy. 172 Volunteer Fire Departments.
05-Command structure for day to day operations:
(A)-Fire Chief
(B)-Asst. Fire Chief
(C)-Fire Captain
(D)-Fire Lt.
(E)-Senior Fire Fighter.
06 ELECTIONS-
(A) All elections shall be held in December.
(B) The board of directors shall consist of seven (7) members.
01.- Two (2) Officers (Fire chief & Asst. Fire Chief).
02.- Five (5) active members.
03.- These offices shall run from Jan.01 to Dec.31.
04.- Nomination of these members shall be made by fire personnel at the November meeting.
05.- Election in December shall be by ballot, in two (2) categories, (1)-Fire Officers and (2)-Board of
directors. (with all applicable fire department personnel listed). (Any member may be eligible for
election to the Board of Directors).
06.- The member with the most vote in each applicable category shall be the winner.
(C) Only Fire Department members with fire training and on active status shall be considered for fire fighter positions.
(D) The board chairman and secretary shall be elected from the board of directors only.
(E) Board member and Ranking Officer, shall make an effort to attend all meetings. Board members, fire members
and / or officers who show a “habitual disregard” for their attendance of meetings and failure in responding to alarms
without a legitimate excuse, shall be replaced by nomination and election by process noted in 6 B.
(F) Any Board Member or Fire Officers, who is elected, then resigns or quits before his / her term expires, shall be
replaced at the next meeting by the same nomination and election process.
07-Monthly meetings of the Peddler Gap And Hwy. 172 Fire Departments are to be held jointly on the first Monday of each month.
Meetings shall be used for any fire department business. Meetings shall be run according to "Robert’s rules of Order."
08-The board chairman or his/her designee shall be in charge of monthly meetings.
09-The board secretary shall be in charge of taking & reading minutes of meetings.
10-Meeting times for the board of directors shall be 30 minutes ahead of or prior to normal meetings.
11-All fire personnel may be given 24 hour notice of specially called meetings. At least 4 board of directors shall be present
to have a quorum for any business meeting. Four (4) board votes are required in the affirmative (yes) for any action
and / or a decision.
12-Cancellation of monthly meetings due to inclement weather or emergencies maybe be called by the fire chief. If this happens
the board meeting may also be canceled, meeting will be held the following Monday if possible.
13-The board of directors is responsible for the financial administration, of the Fire Department.
a.-All expenses shall be approved by the board of directors.
b.-An exception is in emergencies expenditures, up to $300.00, at the discretion of the Fire Chief.
c.-For emergency expenses over $300.00 per month. The Fire Chief shall call a special meeting of the board of directors.
14-All disciplinary actions on firefighter subordinates shall be carried out by the chief. Any disciplinary questions on the fire
chief shall be reviewed by the board of directors, who shall then make a recommendation to all fire personnel for
appropriate actions.
15-Disciplinary action will involve a violation of the by laws or S.O.G.'s.
16-Each fire departments treasurer shall submit a yearly report to the board of directors and to the Kentucky fire commission
prior to the July meeting each year indicating income and expenditures.
17-Fund raisers shall be discussed and voted on by all fire personnel during monthly meetings.
18-All firefighter membership shall be approved by the chief and voted on by all fire fighters.
a.- All firefighter appointments shall be in line with the KY Fire Commission requirements on training.
b.- With twenty (20) hours of training in specific categories required for an officer responding to a fire.
c.- One humored and fifty (150) hours, for certification as a fire fighter. With 112 of the hours in specific categories.
C.- Twenty (20) hours of training are required each year to maintain certification.
19-All fire personnel are responsible for the up keep and maintenance of equipment and buildings.
20-Equipment shall not be used by fire personnel for their private use.
21-Fire department buildings shall be used for fire department use only, except under extenuating situations, such as use by the
RED CROSS, County and State Governmental functions, Forestry service.
22-All financial, business discussions, disagreements shall be settled within the department by fire personnel during monthly
meetings or special meetings.
23-The use, purchase or sale of alcohol and drugs are prohibited by staff and visitors on fire department property, in fire
vehicles or on a fire or emergency scene.
24-Volunteer Fire Fighters who experience an injury or illness that would effect their performances, their safety or the safety
of other fire personnel on a fire or emergency scene, shall be required to produce a doctors statement clearing them for
full duty status.
25-A female fire fighter who is pregnant, shall notify the Chief of her condition. She shall be assigned duties that would not
require any heavy lifting, exposure to smoke or toxic chemicals. Reference Item #-24, when she is returning to full duty status.
26-A personnel file is maintained on each fire fighter that shall include; application, print-out summary of training each year
(beginning 2007), copy of certification, copy of any awards or citations, list of equipment assigned to the
fire fighter (RADIO, TURNOUT GEAR, ECT).
27-Any proposed amendments to these bylaws shall be submitted to the board of directors, if board approves.
The amendments shall be voted on by all fire personnel at the next scheduled monthly meeting.
